People’s Union for Civil Liberties (PUCL) & Anr. v. Union of India & Anr. & Lok Satta & Ors. v. Union of India & Association for Democratic Reforms v. Union of India & Anr. [(2003) 4 SCC 399].
This case was a sequel of the earlier PUCL case. All the political parties had unanimously opposed the judgment which led to promulgation of an Ordinance, which later became an Act. PUCL had challenged the Ordinance/Act by filing a Writ Petition directly before the Supreme Court under Article 32 of the Constitution. The Court held that the earlier judgment (dated 02.05.2002) had attained finality and therefore could not be reopened. Section 33-B of the Representation of People Act was struck down as illegal, null and void. It reaffirmed the voter’s right to know the antecedents of candidates under Article 19(1)(a) of the Constitution.
